Welcome to Residency Partners (the "Site"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("the User," "Client," or "Visitor") and Residency Partners, a boutique investment migration consultancy registered in [Insert Specific Dubai Free Zone, e.g., IFZA or DMCC], Dubai, United Arab Emirates (the "Company," "we," "us," or "our").

By accessing or using our Site and services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease use of the Site and our services.

1. Acceptance of Terms

By accessing residencypartners.com, you affirm that you are at least 18 years of age and possess the legal authority to enter into this agreement. These Terms apply to all visitors, users, and others who access or use the Service. Our acceptance of your use of the Site is expressly conditioned upon your assent to all the terms and conditions of this agreement.

2. Nature of Services and "Not a Law Firm" Disclosure

Residency Partners provides high-level advisory and consultancy services regarding Residency and Citizenship by Investment (RCBI) programs.

  • Advisory Status: We act as a strategic marketing and advisory front-end. We partner with licensed "Authorized Agents," legal practitioners, and government-approved providers in various jurisdictions to process official files.
  • No Legal Advice: While we provide detailed information regarding global mobility and tax optimization, the content on this Site does not constitute legal, financial, or tax advice. We strongly recommend that all clients consult with their own independent legal and tax counsel before committing to an investment migration program.
  • No Guarantee of Outcome: Residency Partners does not guarantee the approval of any visa, residency permit, or citizenship application. The final decision rests solely with the relevant government authorities of the host country.

3. Intellectual Property Rights

The Site and its original content, features, and functionality—including but not limited to the "Residency Partners" name, logo, the Midnight Navy and Antique Gold visual identity, typography (Playfair Display/Inter), text, graphics, and code—are the exclusive property of Residency Partners and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial use. Any unauthorized reproduction, modification, or distribution of our proprietary material is strictly prohibited and may result in legal action.

4. User Obligations and Conduct

As a condition of your use of the Site, you agree to:

  • Provide accurate, current, and complete information when prompted by our Global Lead Intake Form.
  • Maintain the confidentiality of any information shared during your consultancy sessions.
  • Refrain from using the Site for any fraudulent or illegal purposes, including the submission of false documentation or the laundering of illicit funds.
  • Not attempt to interfere with the proper working of the Site, including the use of "bots," "scrapers," or any automated system to extract data.

5. Professional Fees and Payments

Engagement for our consultancy services is governed by a separate Service Agreement or Letter of Engagement.

  • Advisory Fees: Our professional fees are separate from government-mandated investment amounts, application fees, and due diligence fees.
  • Refund Policy: Unless otherwise stated in a specific Service Agreement, professional advisory fees are generally non-refundable once work has commenced, as they cover the time and expertise of our senior consultants.

6. Geolocation and "Smart UI" Disclaimer

Our Site utilizes IP-based geolocation technology to enhance the user experience by displaying relevant regional contact information. While we strive for 100% accuracy, we are not responsible for errors in location detection that may result in the display of an incorrect regional office number or currency.

7. Third-Party Links and Partnerships

The Site may contain links to third-party websites, such as official government portals, Caribbean CBI units, or partner law firms. Residency Partners has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by the use of such content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Residency Partners, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, or use.
  • Rejection of a residency or citizenship application by a government body.
  • Changes in international law or tax treaties that affect the viability of an investment.
  • Financial losses resulting from the fluctuation of investment values (e.g., real estate market shifts in Golden Visa jurisdictions).

Our total liability for any claim arising out of or relating to these Terms or the use of the Site shall not exceed the amount paid by you, if any, to Residency Partners for the specific advisory service in question.

9. Disclaimer of Warranties

Your use of the Site is at your sole risk. The Site is provided on an "AS IS" and "AS AVAILABLE" basis. Residency Partners expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to defend, indemnify, and hold harmless Residency Partners and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

11. Force Majeure

Residency Partners shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. Crucially, this includes sudden changes in government policy or the suspension of RCBI programs by host nations.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre (DIFC) or the local Dubai Courts, at the sole discretion of the Company.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
